Worst Car Dealership Ever, Faulty Cars!
On 2016 June 26 I app**** for a car at CMC Lifestyle for my son (Malusi Ciya 28) who saw it from a CMC employee. The car was approved and I went to sign for it on June 30. When I arrived at CMC and viewed the car it had tires that were in a bad condition so I told them to change the tires first before I sign and they agreed and signed for that agreement to keep record of that. They promised to do the tires in the morning the following day and then I signed the contract which I was not given a copy of but they said they will send it to my Malusi’s email which we used in the application he was not sent a copy. On July 01 Malusi collected the car on Friday before going to work in Cape Town Gardens Wembley Square and the tires were not changed yet. He took the car and went to work with it then took a better look at it and spotted a few problems and then Told Imraan about those issues and he played them off as petty wear and tear issues, which Malusi asked him how is it that there are loose things in the car but it is wear and tear. July 02 Malusi notified Emile who did the finance at CMC that the car seems it had been in an accident and he would like to cancel the deal. On July 04 Emile said Malusi can come in for the necessary stuff to get it canceled but Imraan contacted Malusi to convince him that the car is fine it wasn’t in an accident and the other things he will fix. These are the things that needed fixing below; 1. Drivers seat was loose 2. Hand brake which rolled before holding. 3. Arm wrest which was loose and had a compartment that did not open. 5. Exhaust made noise because it was loose. 6. Front bumper lip has space with bonnet. 7. Back bumper has a space with the boot. 8. Boot plastic on the door which is loose that needs to be put in place again. Tuesday 05 the engine light came on as Malusi was driving to dinner with his girlfriend in parklands and told Imraan and Emile from CMC. Imraan arranged for Malusi to go to their mechanic on Friday 08 to fix the issues. The car tires were not changed at the time, they kept making excuses of having a few people to go and change the tires and told Malusi to drop off the car on Thursday 06. The car was dropped off on Thursday 07 and they said the car will sleep over and they will do the tires tomorrow on Friday 08. Friday 08 Malusi went to pick up the car before work and they had not done the tires yet. He waited between 30 to 40 minutes for them to return with it. He took the car from them and drove to work and when he drove into the parking lot the car started shacking and the engine light came on, it felt like the engine could not keep idle and he parked the car. On his lunch time the car didn’t have the issue anymore and he took the car to the mechanic with the engine light still on and left it there for the night again. Saturday 09 he took a taxi to go pick up the car from the mechanic, the mechanic told him the car has a misfiring piston and pipes that need to be changed that are used to let air out of the engine. He showed him the engine diagnostics and said he has told Imraan. Malusi spoke to Imraan about it and stressing the fact that the car should be in a running condition when it is sold so we cannot have such issues, he said they will fix it. He claimed the car had been serviced the week before the sale so meaning he should have seen the issues. Saturday 09 the car didn’t have any issues after Malusi Picked it up from the mechanic and the mechanic had done all the issues but fixing the drivers seat. Sunday 10 as Malusi was driving to work the car started doing the same thing and the engine light came on again as he was driving to work but it was very bad as he says but he made it to work. At work he
contacted the mechanic wanted him to bring the car on Wednesday 13, then contacted Imraan who said “what does he expect him to do? Why is he being ungrateful after he paid for those things that got fixed in the car” and he asked what is he supposed to do about a car when this car is breaking down in the 1st week? They had a fall out and Malusi blocked him and told him he doesn’t want the car anymore. Monday 11 Malusi went to leave the car at CMC Lifestyle and told them he does not want a car that broke down on the 1st week. Waseem Khan the CMC Lifestyle owner asked if he doesn’t see anything on the floor and he didn’t have anything catching his eye all the cars were high kilometers that he liked. Waseem Khan said that they need to fix the car 1st then see from there on what is the outcome and if that doesn’t work he will offer a replacement or a refund. Malusi asked what must he do in the meanwhile in terms of not having a car? Waseem Khan said they do not offer courtesy cars. Malusi left the car there and went to work where he responded to Imraan’s call which he missed earlier, they had an argument and Malusi told him the issue will go legal and he is not an entity in this issue because he is dealing with the CMC lifestyle owner and this will be a legal issue and we will see what will happen after we’re done with the legal issue. Imraan said Malusi threatened him and was harassing Malusi about going to the Police Station and calling his work trying to get him to be scared and not do what he was doing. He said there will not be any repairs done to the car. Malusi took a screen shot and sent it to CMC. Waseem Khan responded saying they will not do any repairs on the car up until Malusi apologizes to Imraan. The email Threads between CMC and Malusi are available for the person who will be dealing with our case. We asked for a deal cancellation and Waseem Khan refused to do so and said we can go ahead and refer the matter to Ombudsman, Ombudsman will give them the offer to repair the car. We sent a final request for a deal cancellation to Waseem Khan and he responded by calling it a petty reason for the cancellation he will not do it but in the same message said the car will have penalties if we do cancel. The email threads are available for that communication as well. The car does not have a spare key, tire nor a service book and they still have not sent through the contract on July 16.
The above was the issue in 2016. That was a letter sent to Ombudsman. Ombudsman finalised the case and sent me a closing letter to go collect the car but at the time Waseem Khan was already ******ing me for R30 000 storage fee which I will never pay a cent because they are the people who inconvenienced me besides, I was not going to keep a car which was in dispute and obviously had problems for them to lie and blame things on me.
