misrepresentation of facts

<p>I took out a Clientely Premium life cover policy in October/November of 2014. At the time I had no intention of leaving the country. In November 2015 I received an offer to work in the UK which I accepted. Before my departure, in January 2016, I called Clientele to verify whether I would remain covered while I am out of the country, which I explicitly indicates was for a minimum period of 3 years.</p> <p> </p> <p>The call centre agent I spoke to was not sure and thus put me through to someone else (I believe in legal) to clarify this. The lady I spoke to was also not sure and indicated she would get back to me within a few days. A few days later she called back saying I would be covered. This was corroborated by a letter, sent via email, confirming that "cover will be provided in the event that you are overseas".</p> <p> </p> <p>I made the mistake of not saving this letter on my hard drive and subsequently lost access to my email address. A few months after my premiums were increased in November 2016, I called back trying to get a copy of the letter and no one could locate this. I called back again and explained to the call centre agent that I just wanted to reconfirm that I would still be covered whilst overseas. She asked her supervisor who indicated that I would actually not be covered.</p> <p> </p> <p>On hearing this I made an effort to recover my old email address to get a copy of the letter, which I was able to. I logged a dispute with Clientele on the basis that they had misrepresented facts to me when I left the country and I thus continued to pay my premiums based on their misrepresentation. The outcome of the dispute was them insisting that they explained to me, when I initially took the cover, that i would only be covered for 14 days. My biggest issues with this are:</p> <p>1. Nowhere in the policy does it state that cover is for a period of 14 days when outside of the country. Instead the question is "Will you be travelling to or living in any African or Middle Eastern country outside of South Africa in the next 12 months other than for a holiday or a business trip of less than 14 days?".</p> <p>There is clearly no mention of the UK in that question.</p> <p> </p> <p>2. Their premium life plan brochure, on the website, specifically lists the countries where cover is restricted. The UK is not on the list. It further indicates that if the country you are travelling to is not on the list then you should contact them. Which is exactly what I did prior to my departure,</p> <p> </p> <p>3. No one is taking accountability for the incorrect information I was given.</p> <p> </p> <p>I have continued to pay my premiums on the basis that i would be covered. Had it been explained to me that cover would only last for 14 days I would have cancelled the cover.</p> <p> </p> <p>The misrepresentation of facts has resulted in me paying 17 months worth of premiums.</p>
