DECLINED MEDICAL UNFIT CLAIM

I had an injury on duty had several operations and they said the surgeon should have declared me unfit for my duties within one year of date of accident. How could they decide that? And that I had a pre existing condition. I recovered after my first injury and then I was assaulted and now clientele don't want to pay out my medical unfit benefit of my policy. I did refer the matter to the ombudsman but are still awaiting their response. Could someone assist me in this regard
