Clientelle legal always have excuses not to help you out as their client!
I have a problem with this legal cover, it seems like they not willing to help out their clients. In 2014 i got into a joint bond with my then boyfriend, unfortunately things did not work out as we thought they would. 2017 i asked him to release me from the joint bond, meaning that i should sell my half to him so he takes full ownership. i contacted the bank concerned and they forwarded me documents that he must fill in and the accompanying documents thereof . i did as advised but he keeps giving me the run around and makes promises he is clearly not keeping. Basically what he is doing is holding me ranson to this property, because i cannot get clearance from it and i cant buy my own home because it registers that i have debt.
i informed clientelle legal and they all come back to me stating that they cannot help me because i got myself into the joint bond knowing very well what i was doing. Yes i knew very well what i was doing and now that the relationship has failed do i have to be kept ransom to it? where it could be sold to the other partner or if he fails to carry the bond on his own it should be sold to a third party!!!
now Clientelle let me remind you of family law, under cohabitation it states " When the property is in both partners’ names, neither can evict the other from the property. One cohabitant may, however, approach the court to terminate the joint ownership and divide the property in cases where the cohabitants can’t agree. The court will normally appoint a receiver or liquidator who will dispose of the property by way of a private sale or public auction. The proceeds from the sale, minus the receiver or liquidator’s costs and expenses and those of the auctioneer or estate agent, will be divided between the cohabitants according to their respective shareholding. If one partner can prove that he/she contributed towards any improvements and should therefore receive a greater share, he/she may claim unjustified enrichment. So if one partner contributed more towards the maintenance and upkeep of the property, then he/she will be able to claim such payments in addition to his/her share. The court has a wide discretion and may even award the property to one partner subject to the payment of compensation to the other. Nothing can stop a cohabitant from selling his/her share in the property to the other cohabitant or to a third party without the other cohabitant’s permission, unless an agreement exists to the contrary."
Does that sound fami****? why cant you people help me out under family law as it states, yet we pay monthly premiums for legal cover but you people are not helping us! you are suppressing our rights, so in other words you clientelle allow this guy to hold me ranson?
