Breach of POPIA

Subject: Urgent Request to Cease Unsolicited and Harassing Calls — Formal Complaint

To Whom It May Concern,

I am writing to formally lodge a complaint regarding repeated, unsolicited calls I have been receiving from Clientèle representatives — often in the early hours of the morning and throughout the night. Upon answering these calls, there is consistently no one on the line, suggesting the use of robocalling or auto-dialing systems.

Despite my clear attempts to opt out by speaking to your representatives, my calls are abruptly cut off, and my number remains in circulation. This is not only a violation of my right to privacy, but it constitutes ******** harassment in terms of the Protection of Personal Information Act (POPIA) and direct marketing regulations under the Consumer Protection Act.

I demand the following:

Immediate removal of my number from all current and future contact databases used by Clientèle or its affiliates.

A written confirmation from your Compliance or Legal Department that my request has been actioned within 7 working days.

Disclosure of the source from which my details were obtained, as required by Section 18 of POPIA.

Failure to take remedial action within the specified timeframe will result in a formal complaint to the Information Regulator of South Africa and escalation via legal avenues and consumer protection platforms.

Dear Jaques B,

As you requested, we have requested that your details be removed from our database, and a letter to confirm the same to be sent to you.

Kindly note that other companies that receive their information through the same channels may have your details, and you could still be contacted for other promotional campaigns. Therefore, to prevent the same from happening in the future, please ensure that your information is listed on the 'Do Not Contact' list.

Please note that you can also follow the steps below to opt out:

Step 1: Go to https://clientele.co.za/ and scroll down.
Step 2: Select "Clientele Communications” under "Information"
Step 3: Follow the prompts to opt out of receiving marketing content.

It is important to note that all our suppliers must adhere to national legislation, and their data is checked against the national 'Do Not Contact' list hosted by the DMASA. More information on this can be found at www.dmasa.org, and you may register to opt out by clicking the following link: https://dmasa.org/page/register-opt-out-service

We would like to apologize for the inconvenience this has caused you.

We trust you find this in order; however, should you require any further assistance, please feel free to contact us again.

Yours sincerely,

Judith Mboweni
