I was involved in an accident where the driver attempted a hit-and-run. I consulted the legal team to obtain advice regarding the matter. They sent a list of items that I needed to submit in order for them to deal with the whole situation. Everything started nicely until I could not provide the exact documents as requested. Firstly, they requested a sketch, and I provided them with an accident report that has a sketch. To my surprise, I was told the catch has to be separate, as if the accident report is not sufficient and reliable, unlike an individual sketch. No valid reasons were provided other than to state the people responsible for filing need to see a separate sketch for them to proceed.

I was also asked to provide written witnesses. In my case, I could not because I was busy trying to chase the person who was responsible for the accident. Where was I going to get time to do so? It was at night in a location that was unsafe. I do not understand why I would be expected to have witnesses. I provided them with pictures and a short clip that showed some of the events that took place. I guess that was not enough for them because there were no written witnesses despite the law stating you can gather evidence to support your claim other than written statements.

To put the cherry on top, I was also asked to provide damages for the affidavit. I informed the lady that I could not force the panel beaters to sign the document. However, I paid for the costs in their quotation, and they fixed the car. What surprised me was that She said if I do not have the document, then they can't proceed. According to law, damages for affidavit is a common document used; however, it is not the only option that can be utilized. It is shocking that their service can't even extend to a point that they consider alternatives. The invoices that I have paid support the damages suffered. What other purpose can the damages for affidavit serve that the invoices cannot do? I am really disappointed with how they address these matters when you need them the most. It makes me wonder if the individual appointed is serving my needs to the best of her abilities or if I am just the unfortunate one in this case that I am allocated someone that does not know what they are doing. We are not dealing with a complicated case here; it's a liquidated amount case as invoices are available, but it seems it's too much work for her.
