electric frying pan not working

I bought a safeway electric frying pan model nr sefp-001d from your guys and the thermostat doesn't work at all. It seems like the only option is scortch and off. It doesn't regulate the temperature and does not switch off automatically. I've got it currently on 1 and its been cooking on full for about 5 minutes. It does not switch off. The nr 1 setting is supposed to mean simmer but it's been going on full blast now for more than 5 minutes. To simmer something is just not an option on this thing. If I turn it to less than 1 it never comes on. I have to regulate the temperature manually. This is just the nr 1 setting, its got settings going up til 5, but anything over 1 scorthces everything.
