Claim denied on baseless grounds

I had a car incident in which I drove over a stop in the middle of the night on a rainy day. There was no road marking and any signage signaling that there was a stop ahead. My claim was denied on grounds of old markings that were previously there before the road was refurbished. I appealed, and following the realization that they were wrong they changed their statement to I should have known that there is a stop sign and that I accelerated therefore caused the accident.
