Serious injury in a store without as much as an apology

At around 3.30 pm on Wednesday the 18 Jan 2017 I entered Cinnabon, Menlyn with my 6 year old boy, Luke. He and I chose a bun that we intended sharing as a treat (it was his first day in grade one). The bun was given to me in a box and I was busy making a cash payment for it. I asked for a knife to cut the bun in half as we were going to sit in the shop and share it. I was directed to a trolley-table opposite the till counter where the plastic utensils were kept at the back of the table. Luke took initiative to fetch the utensil. I had my back to him as I was paying for the bun. Luke leant on the table to reach to the back of it to be able to reach the utensils. In doing this, the table tipped over towards him and the granite-like sharp edges top fell directly onto 3 of the fingers of his left hand. The table is significantly higher than it is wide, it is on wheels that were without a break mechanism, it is top-heavy and the stone-like top extends in an overhang on the front of it making its centre of gravity high and to the front. It is an unstable and unsafe piece of furniture. Upon turning around to see what had happened behind me I found my son lying on the floor with the toppled table. He was screaming in pain and there was a lot of blood around. I asked for assistance but the staff were unresponsive to my request. I became more insistent looking for assistance from them and I asked them what they were directed to do in the case of an emergency – and still they seemed not to know how to respond to the situation. I also asked for a first aid kit. There was none. I finally ran to the kitchen area behind the counter myself and grabbed a hand full of paper towel to wrap the bleeding hand in. Once wrapped I picked my boy up and made a run for the exit. I took the escalator up one floor and found a Game trolley there. I put him into the trolley and ran for the parking. After finally being able to pay for the parking ticket (the machine I initially tried using would not take coins) I made a dash for the Fairy Glen Hospital where I was helped by the medical staff in the emergency room. The fall of the table resulted in a very severe crush and degloving injury of the ring finger of his left hand. The bone of the last digit of this finger was crushed into innumerable small fragments and the soft tissues of that finger exploded under the pressure of the falling table. The injury of the other two fingers was significantly less severe but did nevertheless require surgical drainage of sub-cuticular haematomas. The experienced orthopaedic surgeon (at Little Company of Mary) who performed the one-and- a-half- hour operation in which he attempted to repair the damage said he has never seen such a severe finger crush injury in his years of practice. He said that had it been an adults finger he would have simply amputated it right away. The finger has now healed but with permanent deformity The store has refused to acknowledge or apologize for the event despite several lawyers letters
