the store cheated me on my refund

I like to register my complain concerning the conduct and unprofessionalism by Cielo Furniture store at the Brooklyn Mall in Pretoria. In April 2018, I placed a couch, a mirror and a dining table and chairs on lay-bye. On 11 December 2018, I went to the store to change the chairs for the dining table; the chairs i initially selected and paid for in full were R 6594.00 and the new chairs are R 4140.00, meaning I had R 2454.00 credit. I opted not be to reimbursed for the difference of R 2454.00, I opted to purchase other items in the store. I bought other items in the store using the difference of R 2454.00 however; I was requested to pay an extra R 587.00 to cover the other items that I bought. Prior to the delivery of the items that I had bought, the salesperson at the store called me on 15 December 2018, to inform me that the legs of the dining table where missing (or could not be found), she indicated that the store would cover the deficit for a similar item as an alternative to what i initially bought. I went to the store on 22 December 2018, (in contradiction to what the salesperson had indicated telephonically on 15 December 2018) the Manager informed me that the store would not cover for the deficit of any similar item that I would choose as an alternative, He indicated that they do not do ‘such things’ and that it was not their fault that the legs of the table could not be found. He further indicated that for the similar item that I had opted to buy, I needed to pay R 5999.00 and the store would consider giving me a discount of R 1600.00. I did not agree with what the Manager was offering so I decided to cancel the dining table, the chairs and the mirror. The store asked that I put the cancellation in writing, so I wrote an email cancelling the items as indicated above, the store indicated that I would be refunded for the dining table, the chairs and the mirror. The amount to be refunded was suppose to be R 10338.00 however, the store wanted to refund me only R 9134.00 which was only for the chairs and dining table (excluding the mirror). When I enquired about the difference of R 1199.00 the Managers indicated that there is a confusion/misunderstanding, they indicated that I should not look at the items that I purchased but should look at the amounts that I paid for the items. On 04 January 2019, I spoke to Jackie a lady who is the Regional Manager of Cielo and their Financial Manager (I cannot recall the gentleman’s name) on the phone, about the refund and the disputed amount to be paid. Both Managers insisted that I should not focus on the items that I bought rather I should focus on the total amount that I had paid. This was not in line with the sale agreement with Cielo and I refused to focus on the total amount as suggested by the Managers, the agreement was on the items and the money I paid for the items, this is the basis of the contract of sale with Cielo. The company only changed its position once I cancelled the items and demanded to be refunded the money I paid for the items.

Furthermore, the Finance Manager suggested to Jackie that I sign a new invoice for the items, which is different from the initial invoice. The revised invoice was indicating that I utilised a some of R 1200 for the previous sales that I had concluded with Cielo. In Conclusion, I want either the total amount I paid for which is R 10338.00 or the mirror, since the suggested refund amount of R 9134.00 excludes the mirror.

With reference to your complaint posted on Hello Peter and other social media platforms.   We dispute the claims made.  Our Financial Manager has spent considerable time telephonically with you to explain the calculations to no avail.    We have audited the transactions again and the calculations are correct.    It is sad to see such unsubstantiated and unfounded allegations accusing us of *****/theft on a public platform such as this.  We do not cheat our customers.  We adhere to proper accounting systems and principles.  We would of course prefer to deal with the matter professionally through proper channels, however since the allegations were made public, we have to make a statement to clarify this unfounded allegation that was made in public. 

We have by no means cheated you and we strongly advise that you consult an accountant.   We have emailed you a thorough email with all calculations.   We are also willing to involve a third-party auditing firm to audit this transaction and are willing to pay the full cost of such audit if such a third party deem the calculations to be incorrect, as well as additional compensation in the form of a substantial shopping voucher.  This would of course be subject to you agreeing to pay the cost of such an audit if our calculations were in fact correct.   Alternatively, you could contact the Consumer Ombud who could look at the transaction for you and advise you accordingly.  We are confident that they will confirm that we have in no way cheated you.

I had a sale agreement with the store I was asked to pay R537 as an outstanding amount . The surprising thing is after canceling the order that is when you audited my account and finding out that I have already spend the money that you must refund me . Yogesh the manager did not phone me to explain the account the only time Cielo tried to explain is when I was querying my refund . I feel cheated and I still want my money back I have invoices that shows that I paid everything in full . Can I have my money back. I saw things on your show room I paid for them . Now when I need my money you telling me about an audit .

Dear Makiti,

We refer to our email from our financial manager.   You should respond to him via email as we cannot discuss details of transactions etc, on this platform.    As mentioned, we have gone over the transactions and it was done correctly.   We have sent a complete breakdown of all transactions, payments and credits with complete ledgers all balancing.  Again, if you do not agree you are welcome to take this to the consumer ombud, or ask a auditor to audit the transaction.  We will gladly pay for any audit showing that we have in any way withheld any payment/credit  due to you.    We understand that you could feel cheated, however this is not the case at all.   Rather we believe that there are some confusion on your part with regards to the transactions.   You have made various payments, returned product, and exchanged products which meant a rather complicated ledger and this could understandably lead to some confusions.  However, we can assure you that the amounts balance and we are willing to have a third party auditor verify that you were not cheated
This will be the last response on Hello Peter on this matter.    All further matters can be dealt with directly via email with our head office.

Hellopeter.com Response to counter-claims made by the CIELO Management Team Good Afternoon The CIELO Management Team (or an individual responding on behalf of Management) responded yesterday (11 February 2019) to my enquiry that I lodged in this platform as well as on Facebook last month It has taken CIELO exactly 1 months and 3 weeks for them to respond to this complaint. Let me dissect and respond to their counter-claim: 1. First, CIELO disputes the claim I made and indicates that their ‘’Financial Manager spent considerable time telephonically with me to explain the calculation to no avail’’ Indeed I did talk to Mr…on the phone ( once off) where we did not come to an amicable solution to the issue at hand, as I stated previously, we had a dispute on the contract of sale, what I was promised as a Customer as well as the invoices in my possession vis-à-vis the invoices CIELO wanted me to sign at the time which I objected. 2. Secondly, in your response you indicate that you audited the transactions and the calculations are correct, on this premise, you take the moral high ground by stating that ‘’it is sad to see such unsubstantiated and unfounded allegations accusing CIELO of *****/theft on a public platform’’, you further indicate that you ‘’do not cheat your customers’’ It is due to this public platform that you have responded to my claim, my last conversation with CIELO, I indicated that you do your administrative processes and revert back to me, there was an agreement to this effect. I was requested by CIELO to put my claim on an email, to which I did, however, you did not respond to this email from…. Until 11 February 2019 when you decided to respond to this Public Platform. Because you have re-calculated the transactions and have found YOUR calculations to be correct, does not imply/suggest that my claim is unsubstantiated and unfounded. In your re-calculation, first, you did not consult me and request the invoice that I have in my possession when I purchased the items, I suppose then your re-calculations are based on the revised invoices that you wanted me to certify by signing them, of which as you know, I refused to do so. So how do you ‘substantiate read: Validate’’ a calculation without all the facts? How is my claim…or as you call it an ‘’allegation’’ unfounded? 3. All you did was to validate yourself that you are correct as you stated ‘’your Financial Manager spent considerable time to explain the calculations to me to no avail’’ whereas, the crux of the matter is on what CIELO promised, on what items/furniture was purchased by me, on what discount and or additional items that I wanted to replace where clarified and the management intervention that I sought to give clarity or to request a refund – You are responding to your ‘’CALCULATIONS’’ and not to my concerns as a CUSTOMER on items I bought at CIELO. Hence, you go to town in labelling my claim as unsubstantiated and unfounded …it is easier to belittle the claim by your CUSTOMER when you are avoiding the facts!!! 4. Thirdly, you had the opportunity to respond ‘’professionally’’ whether telephonically or through an email, however, you failed to do such, now you respond in this platform labelling my claim as an unsubstantiated and unfounded allegation – however, your response is scanty as you do not indicate the process you used to conduct a root cause analysis to understand the source of the problem, who you spoke to or consulted in arriving at a solution and where the misunderstanding could have emanated – instead, you indicate that I labelled CIELO as ********** or ******* and or cheats!! Then you label my claim as unsubstantiated and unfounded based on you proper accounting systems and principles – it so happens that this has no relevance to my claim. Is this CIELO’s professional response to my claim? I spent considerable time, effort and driving from my home to CIELO to attend to this matter and it is acknowledged by CIELO Management as an unsubstantiated and unfounded allegation when I was looking for a solution to this issue? 5. Please Note – I will not consult an Accountant nor an Auditor – how morally inept can CIELO Management be? A Client confronts you on YOUR administrative mishap and you respond by ‘’advising’’ the client to consult an Accountant or Auditing firm? What process did you follow to verify the facts? Or to meticulously explain your approach? Your response is that you re-calculated the transactions and that your calculations are CORRECT and that I should consult an Accountant or a third party Auditing Firm?? Really? Professionalism, ethos of good customer care? What arrogance? Then after all of this, if you are found to be in the wrong you are offering a ‘’substantial shopping voucher’’ what arrogance? Is this the best solution that you can master? Is this how CIELO Management resolves administrative mishaps? 6. I will consult the Consumer Ombud, the National Consumer Commission to seek justice for my claim– as stated before, it is more than a calculation matter, there is a human being read: CUSTOMER, which you seek to dehumanize in your arrogant response. This Human being will seek justice as this matter is not about the money which I think you arrogant response points towards. Lastly your financial manager has never send me any email what so ever . Please provide me with dates
