Dumb Struck!

<p>On the 10th November, one of CIB Insurance's client, drove into the back of me. Everyone agreed I was completely innocent! As such, I approached CIB as a third-party claim. Apart from having to return their "without prejudice" document, I had to send them a whole lot of certified documents, a letter stating why I considered myself the innocent party, a letter from my insurance company stating that I would not be claiming from them and then two quotes from panel beaters of my choice. I was then told I needed to take my car to their assessors for final assessment. The first quote was R81,295 and the other one was R70,648. The assessor valued the damage as R41,586. However, they indicated "previous damage" as R4,500 - scratches & faded. The Retail Value of the vehicle is R32,500 and the Trade Value of the car is R23,900. It therefore makes sense for them to right the car off. However, CIB Insurance are only offering to pay me R14,812.50 "within approximately 21 days" after having signed their "Without Prejudice" Release Form! When I phoned Annelien van Zyl from CIB Insurance for an explanation, her logic was R23,900 less the R4500 less an amount they deem "fair" because they would leave the car with me to dispose of! I then told her that I would be taking this up with the Ombudsman and she told me that I can't do that, but if I did, the Ombudsman would just refer me back to my own insurance company, because I am not a CIB Client! How can this ever be deemed fair!</p>
