Formal Legal Complaint and Demand for Compensation – Sale of Unsafe Meat Product (Consumer Protection Act)
Dear Checkers Customer Care / Legal Compliance Team, I hereby submit a formal legal complaint regarding the sale of an unsafe and spoiled meat product purchased on 17 December 2025 at your Checkers store located at Reef Shopping centre in Germiston. On the above-mentioned date, I purchased a T-bone steak and a rump steak. Upon opening the packaging of the rump steak at home, I was immediately met with a strong, putrid odour, clearly indicating that the product was spoiled, rotten, and unfit for human consumption.
This incident constitutes a breach of the Consumer Protection Act, 68 of 2008, including but not limited to:
Section 55(2)(a) and (b) – the right to goods that are reasonably suitable for their intended purpose, of good quality, and free of defects;
Section 56 – the imp**** warranty of quality entitling the consumer to a refund, replacement, or repair; and
Section 61 – strict liability for harm caused by unsafe or defective goods.
The sale of spoiled meat poses a serious health and safety risk and reflects a failure in quality control, food safety management, and consumer protection obligations expected of a national retailer.
Demand for Remedial Action and Compensation In light of the above, I formally request the following remedies:
compensation in recognition of the inconvenience, loss of trust, and potential health risk suffered, in the form of:
A store credit or voucher equivalent to the value of the affected purchase, or
An alternative form of goodwill compensation deemed appropriate by Checkers;
Written confirmation of the internal investigation conducted and corrective measures implemented to prevent a recurrence;
and
A formal written apology acknowledging the breach of consumer rights and food safety standards. Especially with the lack of empathy the store manager displayed during my complaint in-store. I would also recommend that formal training is provided to the manager for handling of such complaints and show remorse and social behavior of putting the consumer at ease following such a horrific experience.
These requests are reasonable and aligned with the spirit and intent of the Consumer Protection Act, which seeks to ensure fair, responsible, and accountable conduct by suppliers.
I reserve all my rights in terms of the Consumer Protection Act and any other applicable legislation.
Should this matter not be resolved satisfactorily within a 48-hour period, I reserve the right to escalate the matter to the National Consumer Commission, relevant food safety authorities, or pursue further legal remedies.
