Why waste you time and money

<p>my wife and I decided to do the sensable thing and rent out our house which is too big for the 2 of us. I advertised at many different companies, but Chas Everitt was the company that got us excited. They told us on the 21st of February that we need to be out by the 1st of March because they have someons for our house. We told them the condition to my house being available is that they find a place for us to rent, which they did and on the 23rd of February we were full on busy packing up our 4 bedroom house.</p> <p> </p> <p>On the 27th I was told that the tenants already signed all the documents and that they were waiting for me to sign. I met with them, signed the documents and enquiered about the deposit, which they ensured me it will be paid in later that day. I confirmed with them that the tenants is moving in on the 1st of March which they agreed and said that they will definitely move in, WE MUST PROCEED TO MOVE OUT. Which we did on the 28th of February.</p> <p> </p> <p>A long story short, they didn't communicate with us, we moved out only to find out a few days later that the tenants canceled and that they in fact didn't pay any deposit or signed any documents. We agreed to move out on their instructions, withot them having received any deposits.</p> <p> </p> <p>We are holding Chas Everitt responsible to pay our rent up until such time that our house is occupied. I have spoken to the franchise owner, which ensured me that their lawyers would contact me, which still haven't happen. I'm trying to get hold of them, but they are not available. </p> <p> </p> <p>We are now still paying our bond and our rent at out new place as they were *********** and told me to move out before they had anything official. </p> <p> </p> <p>I'm still holding Chas Everitt responsible for my rent, as my house is still standing empty </p>

Good day Mr vd Linde,

Herewith the report from the attorney that was looking into the matter,

Dear Rod,

As per our discussion yesterday, please be advised that I have received confirmation from Angie- Chas Everitt that the following events transpired after the meeting between myself, Mr Van Der Linde, Angie and Katherine at the offices of Chas Everitt Amanzimtoti.

Latest Facts:

A tenant was secured, a lease agreement was signed and the tenant moved into the property the following weekend.
Three months rental was paid to Mr van der Linde upfront together with a household deposit.
Mr Van der Linde did not move back into his property although this was my recommendation.
Kindly be advised that at the meeting held with Mr van der Linde the following was discussed, established and agreed to;-

Prior Meeting:

Mr Van Der Linde was aware of the fact that he did not have a guaranteed tenant at the time of moving into the cheaper flatlet. This discovery was made when another potential tenant came to view the flat on his 'moving day'. Regardless of this, he still proceeded to move out of his home and sign a new lease agreement with the landlord of the flatlet.
Mr van der Linde was unable to pay the deposit and the first months rental on the flatlet. The landlord of the flatlet had under the circumstances agreed to cancel the lease agreement without claiming for any damages from Mr van der Linde if he vacated the property.
Chas Everitt had agreed to forfeit their commission on the flatlet (one months rental)
Chas Everitt had also agreed to arrange trailers to move the furniture back into his property free of charge due to the inconvenience.
