Excess paid on item still under warranty

<p>I had to pay an excess to replace a thermostat/element as advised by my rental agent.</p> <p>This was paid to ensure my tenant can have hot water again. After reconciling my payments, I saw that the geyser was still under warranty, and that the thermostat/element also carry a 12-month warranty.</p> <p>Chaz Everitt refuses to acknowledge the manufacturer warranty and keeps information me that only a 2month warranty is available.</p> <p>As a client, I trusted that my agent will inform me should something still be under warranty.</p> <p>I requested a refund of the excess payment, but to no avail, just excuses why I will not receive my excess back..</p> <p>This is unacceptable, why should I be held liable for a payment not due by me in the 1st place</p> <p> </p> <p> </p>

Dear Mr. Marè,

I believe you have been communicating with Jamie Bradbury, the group's Regional Manager for the group.

We would like to confirm the following;

The Body Corporate did confirm that the thermostat and element was not under warranty at the time the repairs had to be done, and that this was communicated to you.

The element and thermostat have a 2 month Warranty which had expired by the time the contractor (GSPM) was instructed to repair same.

The work/payment of work completed was approved by yourselves, and GSPM proceeded..

On the 29th of August 2016 a letter was also issued by Body Corporate stating: "..The cost of replacement of geyser elements and or pressure relief valves are the responsibility of individual unit owners and such cost would be charged to them directly." This was received by all owners and managing agents and we received confirmation from yourselves that you had received the letter.

Whilst the Manufacturer may have stated that there is a 12 month guarantee in general on their products - The body corporate only received a two month guarantee from their supplier.

We always regret the loss of a client, however we do feel that we have acted both within our mandate and in your best interests at all times.

How can the body corporate and agents decide what warranty period is applicable?

I contacted the suppliers directly and they confirmed on email that the thermostat and element carry a 12-month warranty.

The work was approved by us, yes, but we were never informed that the warranty was still in place, this was never communicated to us.

Referring to the letter from the body corporate, this was sent after the complete geyser was replaced, thus we should still be entitled to a warranty as per manufacturer.

This is ****************, someone made a mistake and now the rules are being bent to suit you and cover up the mess.

I won't even pursue this matter any further as it is an utter waste of time, just shocking how a company can do this to their clients, but I guess no shame when it comes to the corporate world. Money 1st, reputation 2nd, clients last.
