Negligent and unprofessional

My girlfriend and I recently purchased a property from Charvette from Charvettes Properties and are new homeowners. The property registered in March 2017, and we have had problems since the process started. Upon viewing the property, there were two aircon units and two satellite dishes on the property, but when the property registered to us, the previous owner took the aircon units and extra dish with him.

When we queried this with Charvette, she claimed that the aircon units were never part of the contract and she was adament that she mentioned this to us when we viewed the property, which was not the case. It was never noted in our OTP or the contract. She then stated that this clause was on the previous owners OTP, which we were not aware of and did not sign for.

Once the previous owner and Charvette realised that we were going to take this further by going to the small claims court and starting this process, we only then received two aircon units (which were not the ones originally on the property, they were broken secondhand ones.) Once we knew that these were not in a working order, we sent Charvette an email stating what our next step was and we sent a letter of demand. Only then were we contacted and issued new aircon units which was installed.

We feel that Charvette was negligent and unprofessional when it came to the clauses set out in a binding contract. It felt like Charvette was trying to cover up for the previous owner and look out for the best interests of him. There are still plumbing and electrical issues that we are still trying to sort out. We feel that the COC`s that were issued are invalid, and are in the process of taking this further.

Shameek
