01 Sept 2021, 09:17Good day Clinton As per our numerous communications with you since last year, you have been informed on all these occasions that you were in breach of contract when you moved out, therefore you forfeited your deposit. When you moved in, you received a two-month rent-free promotion and a rental discount that was only valid on a 12month lease agreement. When you terminated your contract, this promotion was void, therefore you are now liable to a two months’ rent penalty. Please refer to clauses 1.28, 1.29, and 21 in your signed contract. Please also view the terms of the Consumer Protection Act, 14.3 a, and b: Upon cancellation of a consumer agreement as contemplated in subsection one b. (a) the consumer remains liable to the supplier for any amounts owed to the supplier in terms of that agreement up to the date of cancellation; and the supplier- (b) may impose a reasonable cancellation penalty with respect to any goods supp****, services provided, or discount granted, to the consumer in contemplation of the agreement enduring for its intended fixed term if any. Your deposit is not refundable. Our decision in this matter is final. Should you wish to proceed with this case, please contact our admin office to make payment arrangements for the penalty set out in clause 1.28. Once we have received the full outstanding penalty fee, we will proceed with the deposit refund.
