UNPROFESSIONAL CCMA COMMISSIONERS

This is the experience I had at CCMA and I sent the email below. To date nobody wants to respond to me.

Good day,

I would like to inform you that we attended our meeting at the CCMA on Friday.

Our appointment was at 12pm, however we were waiting from 11.45am and the complainant only arrived at 12.30pm, which I felt was unfair.

Secondly, the comminsioner came up to us at 12.15pm and insisted the case has been dismissed because the complinant arrived at 11.30am. My husband and I raised our voices and argued that it says 12pm on the sms and email and therefore it was not fair. After that he changed his tune and said I was joking in a stern manner.

The commisioner then went onto saying that we have to wait for half an hour more before dismissing the case. However when I sat in the waiting area, there was a company called Quality products and 15 employees were waiting. The female comissioner said if the company owner/ representative does not show up in 10 minutes, then shes dismissing the case. So howcome we waited for half an hour from the given time??

What I found suspicious was that when our ex-epmloyee walked in, he went straight to the comissioner to talk, which I found odd.
I don't think it's fair that he met with the comissioner before our meeting. How do we know what the comissioner had discussed with him before our meeting?? In fact how did he know which comissioner was even appointed to us? Because we did not know.

Next within the first half an hour of the meeting the comissioner had the nerve to state that he has the power to make us pay between 1 to 12 months if he wants. He then went on to say in a sarcastic way that I am not worried because it's not my money as if he already made up his mind and imp**** that we are quilty.

When I said I was diappointed because I treated him like family, while our I was talking the comissioner disturbed me and said "Well all you people say the same thing". I personally think that was a ****** remark.

When abitration started he forgot to swear our ex-employee in and paused the recorder ( therefore that part is not on their record) and swore him in after he completed his entire side of the storey. This is not acceptable.

He continued to pause the recorder whenever he felt like and spoke in zulu and at one part they were not translating to us.

To show you how ******* this situation became, the translator told my husband and I that if oscar pistorious can get away I don't have to say anymore. So what was that comment suppose to mean??

There is much more that went on but I just wanted to brief you on what had actually transpired. The main thing was that our ex-epmloyee was intoxicated and we had a dispute, he then left on his own accord because that is the nature of this employee and I showed the comissioner proof by bringing my attendance register, but he did not even look at it.

He also did not want to hear that part where we spoke about the epmloyee being intoxicated and kept on changing the subject and trying to confuse us by saying that is not of importance. He said only the dismissal/ dispute is important which I don't think is right. How you only talk about the dispute whitout talking about the events that lead to it? He kept on pausing and interupting me.

Lastly, After abitration they called us back to sign the form because the comissioner forgot about that too. However the building was empty because everbody had left and the employee remained in the room and they continued their conversation for a while. So what were they continuing to talk about? To me this looked very suspicious and *********.

Before we left the room, the comissioner said we will get a letter. So I asked him will we not get an sms or email, he said no, a letter will be delivered to our shop.

The bottom line is I am not happy with the way this was conducted and I am not happy with the unprofessional comissioner that was appointed to me.

What is CCMA going to do about this commissioner that is what I would like to know because this ********* behaviour. Is this the type of commissioners that CCMA employs?

It's pointless taking employees sides especially the ones who ***** ,then run to CCMA to cry wolf when there's *******ion within the CCMA itself!!!

Reviewer Update

After posting my complaint about the CCMA, the email was then "APPARENTLY" sent to the senior commissioner which has still not responded to me at all.

Oh and what a surprise..... the employee had won the award and they want me to pay him almost R8000!

The commissioner did not write that the employee was intoxicated and went on to lie further on the report that said the employee handed in his uniform...he has both his uniforms with him by the way.

*******ion is one thing, this commissioner was also ******. Only because the commissioner was black and our employee was black, he hepled him out and this is a fact.

Watch out people! Don't give in without a fight especially when you know you are not guilty.

Everyone complained about apartheid and the whites being ****** but what about the blacks being ******????

To me it feels like we living in the reversal of apartheid!
