CCMA - Poor Service
On the 26th of March 2021 I felt I was unfairly dismissed from my place of employment. I submitted all my details to the CCMA Durban branch and my case was activated on the 31st of March 2021. On the 12th of May 2021 I received an email stating "Note that this matter could not be conciliated within the prescribed 30 days, Upon receipt of this certificate, you now need to file a form 7.13", which is for Arbitration. I then sent all my details for Arbitration. On the 06th of July 2021 I received an email from Matlakala Elizabeth Bodibe (***) stating that my case has been Withdrawn with no reason whatsoever. I contacted the Durban Branch on the 07th of July 2021 to get information and they advised me that my case is awaiting a date for Arbitration, I then advised them of the email and the the name of the person that sent it to me and they advised that there is nobody by that name that works at the CCMA. This has now got me confused and wondering what exactly is happening at the CCMA. I also would like to add that the lady I was talking to on *** was rude as she just disconnected as I was still talking to get information on this. Can someone please advise what is happening with my case KNDB2954-21 as it will be very unfair if this case is withdrawn because I have not had the chance to provide my side of the situation. I am really sorry for complaining but please understand my situation. Thank you.
Case KDNB2954-21 is not withdrawn. The certificate of outcome was issued because the case could not be conciliated within the prescribed period. We also received the application for arbitration. There is no date allocated as yet. In terms of our standard operating procedures, the arbitration date will be set down within 90 days of the date the referral was received. We do have Elizabeth Bodibe who is based in our National Office. We would like to apologize for the misunderstanding and any inconvenience caused.
