CCMA
The CCMA is suppose to be this "court" where justice and fairness should be the foundation but it is everything but that. The CCMA is there to support employees who voilate, abuse and break all the rules and the employer has no say to protect himself. I stay in Gauteng and was on a trip in Mpumalanga when I received a sms notification on a Saturday mid-day that I have to be the following Tuesday in Johannesburg for a hearing. On the Monday I called the number as was rudely reminded that the CCMA had sent me a notification to my business address two weeks earlier. I requested a new date as it was impossible to be there on their date and I was told that the case will continue without my presence. I called a relative to attend on the day but it was also a waste as judgement was against me as my representative was not prepared for the case. I was told that I must pay 3 months salary to n employee who had many warnings against her for several serious offences which include swearing to other staff, refusal to take instructions, away from work without permission on several occasions. Aggression against employer and throwing around furniture, Formal hearings were done which she signed for and when dismissed she refused to sign and accused me from unfair dismissal.
My representative was told she could go for arbitration but was warned that the penalties can be more strict and that this "Superior"is actually very lenient to us.
Sad to say, I did not replace her and do the work myself... after 3 months she arrived at the office again and beg for work because the free money is used-up...let her sit at home and suffer. An unhappy employer
