Blatant bribery

<p>I app**** for unfair dismissal at the Hohannesburg CCMA, representing myself. </p> <p>After failing to give me a fair hearing because I was hospitalized on the day of the hearing, with documented proof from the hospital and my doctor, the commissioner, Mr Coen Havenga, took it upon himself to continue with a prejudiced hearing involving the labour representation of my previous employer. I was not given a chance to present my case or my evidence in a fair hearing. </p> <p>I app**** for a recision immediately on 17 November 2016, and was never informed by email or by phone that the matter was due for revue on paper on the 12 December 2016. I was neither informed by the CCMA via email nor via phone that the matter had been decided on on the 21 December 2016. I have been trying to get an answer as to my recision since the CCMA reopened after the December break.</p> <p>I finally managed to get the ruling today, 19 Janauary 2017. Recision declined on the basis that I did not provide any evidence of employment, which I was never given a chance to present. </p> <p>My case was submitted at the Johannesburg branch. Both rulings have come from the Kempton Park branch. Both rulings by the same commissioner, Mr Coen Havengs, whom I have never had the opportunity of speaking to with a fair chance at a hearing. </p> <p>What is going on here? Is this fair labour practice in disputes?? As I am representing myself, naturally it is more difficult in terms of not being a fundi in labour law. But isn't that what the CCMA exists for? To give the disadvantaged a chance to be fairly represented? </p> <p> </p> <p>Frankly, I am disgusted. I don't even k ow where to turn or what recourse of action is available to me. </p>
