Advised by a CCMA officer to break the law, ignored and disrespected

Second Complaint, Same matter, no resolution! Case Number: GATW 6277-20 Applicant: Mr. S Malema

After being embarrassed, ridiculed and ill-treated by some CCMA officers and amongst other things also advised by an official CCMA officer that I should deliberately break the law by committing an ******* act, this is where I once again find myself: My first Hellopeter complaint was responded to by the CCMA in a form of a letter. The letter sent to me still had the same issues and irregularities which I complained about in the first place. So basically the letter just repeats the same issues I want addressed or needed assistance with. The only good thing about the above-mentioned letter is that at least the CCMA acknowledged the wrong and the unprofessionalism of some of the officers who worked on my case.

This is how my Hellopeter complaint was handled: You would think that the CCMA would call me first to get my side of things before writing me a response letter since I’m the complainant. I was only responded to by a letter written by CCMA’s Boitumelo, which as I mentioned, did not help me at all. On the 2nd of November I sent a response e-mail to the author of that letter and other CCMA officers flagging that the contents of that letter are not accurate and as a result, that letter should be rescinded as it cannot be valid if it contains the same irregularities, inaccurate or misleading contents regarding my case. To date, there’s no response to my e-mail. Seeing that there’s no response, both myself and my advisor, Clifford Khoza, attempted to call the CCMA. Contact was made with Martha Moloto who rep**** by saying the letter sent by the CCMA is final and it shouldn’t be questioned at all. She failed miserably to respond to any of the concerns raised about the letter, she just kept on saying the letter cannot be questioned. Since Martha Moloto couldn’t help me as she kept on repeating the same thing over and over again, Nokhanyo Madiyibi also got involved. Nokhanyo promised to call back or at least get Boitumelo Mokoena (the author of the letter) to call me back, but still no one attempted to reach out to me at all.

Again, seeing that no one is interested in calling me back, I then tried calling the CCMA but its either phones are not being answered or I get someone I don’t know promising to get Boitumelo or Nokhanyo to call me back. Till today, no one has bothered calling me back. For the sake of getting this matter to finality, may I ask that a Senior CCMA official call me? This time around, may I get someone who is prepared to at least listen to what the main issue is and provide an answer to the red flags I raised as the people I have engaged with before seem not to care or willing to listen or look into the irregularities regarding my case.
