Terrible company. Breach of contract from their side. Damaged my petrol Gage. Deceived. Rotten service.

I signed up for a 24 month contract, I wanted to cancel directly after these horrible 24 months have passed - request was ignored. Bank account kept on being deducted. After months I finally got a response...telling me I am liable for 36 months...no ways. After Cartrack installed the unit in my one vehicle it was successful but after installing the unit in the second unit the fuel gage no longer worked, I did call and report and was told I would get a call back...no call back and gage still not working. Furthermore, Cartrack did not at all issue me by hand or mail a hard copy of their T&C's or exactly what they are offering because what I was sure was part of the packet that they sold me apparently as I am now told more than 24 months ago, is only included at an additional fee. According to the consumer law they should have seen to it that the contract/agreement was either delivered to me by hand or mail within 48 hours of my consent, this did not happen, I was asked by Cartrack why I did not call to remind them to send it to me. Although I have called their customer care numerous times about my fuel gage which I did not even bring up in my recent discussions with their "customer services" due to the fact that through my experience with Cartrack it would prove fruitless. I do not believe that I am liable for one cent further more I believe Cartrack has to refund every cent they deducted from my account as this was ******** as I did not receive the exact details as to what I was paying for.

So I do not know if CarTrack has some secret language or if it is me who just can not communicate?

Message from CarTrack:

Dear Valued Client,

This is an important email and requires your immediate attention .

Despite sending you several reminders, we have received no payment from you for the overall arrears on the account. We feel we have given you ample time and have been more than patient on this matter.

Therefore:
We are of the opinion that there is no recourse but to put your account in the hands of our collection agency. This action will affect your credit rating negatively and we will be obliged to report this to all credit bureaus for listing.

I earnestly request of you to consider the matter seriously and make the necessary payment at the earliest.
Our banking details once again are as follows:

Beneficiary : Cartrack (Pty)Ltd

Bank Name : FNB

Account no. : ********** 6281,

Branch Code : 254605

Reference : Please use your unique Cartrack username or ID number.

We sincerely hope you will give this matter serious consideration.

My response:

Dear Donald

Please listen carefully to me, I am know at the point of taking you to court!

As per my complaint on Hello Peter – a reply from cartrack but that’s where it stopped…

As per my many mails between me and numerous staff members at Cartrack

Here are the facts

Cartrack owes me every single instalment I made BACK – WHEN CAN I EXPECT THE PAYMENT MADE????? PLEASE ENSURE IT HAPPENS REAL SOON.

Some fun facts for you: I only consented to a 24 month contract – I paid for more than 24 months. – Provide me with solid proof where you state differently.

YOURE TRACKING UNIT IS THE CAUSE OF THE NISSAN’S PETROL GAGE NOT WORKING, the emotional stress of not knowing the fuel level is unexplainable! Cartrack has till the first day up to today not responded once in coming to fix there ****** up. – WHAT IS CARTRACK GOING TO DO ABOUT THIS DAMAGES THAT YOU CAUSED.

I was not presented with a hardcopy or even an email containg your Terms & Conditions or the contract stating anything more than 24 months (which you *******y debited anyway as not presenting me with the hard copy contract or email contract makes this all null and void and the debits ******* – please consult your legal team on this)

Further more, even on the add-on form (for the Nissan) does it no where at all state any duration of contract.

So Donald, I urge you to provide me much needed proof and to stop harrasing me, I will update my report on Hello Peter accordingly.

The response from CarTrack:

Dear Valued Client,

I hope this email finds you well.

If you would like to take us up on this offer kindly notify us in writing to ********** or contact us on 011 ********** .

Once again I request, just please mail me black on white where I signed up for anything more than 24 months. Please also prove to me where you have issued me with the terms and conditions. - Is this to much to ask?
