Is Cartrack running a ****?

On or about 14 May 2021, I signed up with Catrack for their Fleet Management Plus vehicle tracking devices for two of my vehicles. This was a recommendation from my new insurance company. Cartrack’s value proposition/contract provides for the payment of a recovery warranty amount of R150 000 if they cannot recover a ****** vehicle. On the day of the telephonic contracting with their agent, I was asked about my preferred date for the debit order and I advised that this should be the last day of the month, a similar date I had provided to my new insurance company a few days prior. To my surprise, direct debits were run on 28th of the month for both May (June cover) and June (July cover), contrary to the end of the month which I had indicated during the telephonic contracting conversation. Both debits were returned as there were not funds in my account at the time however EFT payment was immediately made for the June premium whilst a successful debit was re-run on 2 July for the August premium. I have requested for the call recording, and I am still waiting. On 16th July 2021 I had the unfortunate event of one of the vehicles being ****** and has since not been recovered. I received a few phone calls from Cartrack on the day to update me on the search and only one missed call the day after. To date I have received no update in this regard. On 3rd August 2021 I submitted all required documentation for the claim of the Recover Warranty as per contract and was told that it would take 60 working days to process the claim. I received no feedback on progress since 3rd August 2021 and upon following up on 7 September 2021 was told that the matter is still being investigated. Today, 4th October 2021, I received a letter declining the warranty claim. The rationale provided is that I had defaulted on payment in June and July where the failed debits were as a result of Cartrack’s fault. In addition, that I had provided a copy of an expired driver’s license, a matter that was not raised and/or queried at the time of application. Besides, at the time of contracting, I had already app**** for the renewal of my driver’s license and had not received the new one due to the COVID-19 related backlog at the traffic department. Cartrack is also conveniently ignoring government’s directive on the extension of the validity of drivers licenses. This nitpicking where there is no fault to avoid honouring their side of the contract is sickening! I AM DEFINATEY NOT LEAVING THIS UNFAIR PRACTICE UNCHALLENGED EVEN IF I HAVE TO GO TO THE HIGHEST COURT IN THE LAND FOR THE SAKE OF OTHERS.
