Evading a 'fair and reasonable' termination fee for contract

Set account, CHAN00188, was initiated as per the instruction of MiWay in regards to the insurance of my then owned Ford Ranger.

Two years and two months later, the Ford Ranger has been sold. I initiated set cancellation in writing to ***, the fax number of *** & posted it in as well.

There was no response nor acknowledgement, so I called in and engaged Lumka Ngqame and was emailed a cancellation fee of R 1,101.10. This is grossly unreasonable as the CPA over-rides bad faith clauses of this nature in contracts held with individual persons like myself, and indicates that a 'fair and reasonable' cancellation fee be initiated.

I'd very much appreciate the latter point to be enacted without delay as I don't intend to pay for another's vehicle (legally the transfer of set car ownership has been completed) being tracked at my expense.

Your kind attention to this point and fair conclusion to this matter be appreciated.

This matter has been followed up with both Mpho Mohgashoa & Lumka Ngqame wherein a transfer of contract has been completed! The responsibility now falls on CarTrack to follow-up with the new owner of the vehicle.

Further to this, this misrepresentation wherein the Consumer Protection Act involving a 'fair and reasonable cancellation fee' can't be misrepresented nor negated by loophole clauses by CarTrack.

I'm glad to be done with this company!
