Cartrack fail to perform according to contract

In July 2023 I phoned Cartrack to trace my car. I was informed that the traking unit is out of order. I was told to phone Cartrack next date and report again. Unfortunately, I forgot about the issue. Since then I have been paying Cartrack for a unit that does not work. This fact was also logged on Cartrack side and nobody from Cartrack also contacted me to inform / remind me.

Cartrack does not want to repay me my installments and says it's my fault I paid them for nothing. I agree that I made a mistake but I certainly did not donate my installments to Cartrack.

If Cartrack want to focus on fault - I can also play the came. Cartrack indicate that 'units are frequently tested automatically'. I see this as misleading, if this was the practice then why did Cartrack not discover my unit was out of order before July 2023. Further, why did Cartrack not discovered my unit was not working after July 2023. I would like to see those 'auto test logs on my car'. Simple they could have contacted me.

The law is about what is fair and just. Cartrack refuse to pay me any of my installments back. I have paid my monthly installments (I performed according to the contract) it was impossible for Cartrack to perform according to our contract, the unit did not work - so I received no reciprocal value from Cartrack.

Cartrack has no legal right to keep my installments whilst it could not perform according to our contract. Cartrack will suffer no loss if they pay my installments back.

Nobody at Cartrack even want to consider this - I find some aspects of Cartracks service claims as *********.
