CAR TRACK

on the 10/12/2021 my car Hyundai I20 was ****** at Midway mall in Newlands west while my wife went for shopping she called me i then called my Car track to assist locate my car while i was driving to the mall where my wife was. On my arrival to my wife i used the app to locate my car and it shows me that it was +-7km away from the mall i contacted cartrack to informed them they told me not to disturb them because they were still searching they then blocked my app for me to see my car on the app. On the following day I gave them a call to now how far with their search they told me that they were still looking. They did not bother to call me i was the one who always called them. after 2 weeks i tried to claim from them since they did not find my car. They respond with this :-We received your email/query on 21 December 2021, regarding the unfortunate incident with your vehicle.

Please see attached the Cartrack terms and conditions.

In accordance with the Cartrack Service Agreement entered into on 06 June 2019, the Limited Recovery Warranty is subject to specific terms and conditions set out in clause 10, which state, inter alia:

10.1.2. Conditions and Limitations:

10.1.2.1. This warranty shall only apply to Vehicles classified as motor vehicles licensed to travel on public roads and utilised as a means of transportation for people and/or cargo, subject to clause 10.4.14; and to the Cartrack Products which provide SVR, with the exception of mobile and trailer-tracking devices; and which are sold and installed after 1 September 2012 and until such date as Cartrack may decide to terminate the offer of such warranty on notice to the Client; and where the Fees for the Service are paid for in accordance with the Price Table updated from time to time; In this premise we regret to inform you that you do not qualify for the Limited Recovery Warranty.

The product package installed does not have the Limited Recovery Warranty.

8. Client’s General Obligation 8.1. It is the responsibility of the Client to contact the Cartrack control centre for a Unit test to be carried out in terms of clause 10.1.3.4. The Client must take all reasonable steps to ensure that the Unit is in proper working order and must immediately or as soon as is practically possible report any Unit faults and/or failures to Cartrack in order for Cartrack to provide the Service.

10.1.3. It is the responsibility of the Client to:

10.1.3.4. Contact Cartrack every calendar quarter to test the Unit, notwithstanding any system generated or courtesy testing undertaken by Cartrack. If notified by Cartrack that the Unit is faulty, the Client must make the Vehicle available for inspection within 3 (three) working days;

You did not test your unit quarterly.

10.4. Exclusions: This warranty shall be invalid if:

10.4.8. The Client has defaulted in respect of any payment due to Cartrack or the Vehicle’s financing institution, at any time preceding the Loss;

There were default payments on your account:

2019-09-28 Reverse Payment (Debit Order Unpaid (2) - INV-***8)

Please note that failure to comply with any of the above terms would result in the rejection of the Limited Recovery Warranty.

Whilst we sympathise with you for the distress and inconvenience experienced as a result of the loss we must remind you that it is the clients responsibility to be aware of the terms and conditions of the agreement.

In this premise we regret to inform you that you do not qualify for the Limited Recovery Warranty.
