After 3 Years car still not fixed

I took my ssang yung musso to Gawie in 2012 I paid him the money he said I have to pay R7800 to fix my 4x4 time passed I phone and he always has some or other lame excuse as to why car not finished. Not once did he phone us to say that anything was short or so he just never came in contact with me. I went to consumer protection and not even they can help me I want my car back and I want my money back. Please help me. This guy is very arrogant and uses fowl language over the phone with me. My husband is a rep and we need 2 vehicles to be able to get around for 3 years I have been struggling I think this is enough I will no longer handle this. I want my vehicle back. I phoned motorboard but they don't help me as well.
