Complaint with a car dealership

To whom it may concern,

On the 17th August 2016, I took out a loan of R93 000 at Capitec, in order to purchase the Mini Cooper S. After having the loan approved the loan was transferred into the dealerships (AW Autohaus) account immediately.

The difference(R16 000), of the money owed I was going to receive at African bank, but they could only loan me R12 500, which they could not release on the 17th August 2016, because they needed me to be 3 months permanent of which I would be 3 months on the 1st September 2016.

On Friday the 19th I informed the dealership that I would no longer be going on with the purchase and needed the R93 000 reversed back into my account so that I could return the loan back to the back as I would no longer be needing it and I needed that done ASAP before Wednesday the 24th to avoid paying anything more than the R93 000 that I took out. In doing so I would also be avoiding paying the R4000 instalment on the loan and having to pay interest on the loan.

The manager Azeem the told me that since I’m cancelling the deal I would have to pay R10 000 in total for the services I have cost them as the company, i.e. taking the car for service, having the car transferred into my name, admin fees etc.

Over the weekend I changed my mind about cancelling the deal and let my salesman(Paul) aware of the matter, but still told them know that I wanted the money refunded, because I would be taking the car on vehicle finance and no longer will be paying cash, the salesman said Monday it would be dealt with. Of which nothing was really done on Monday due to the matter.

Wednesday the 24th I told them that I’m no longer interested in the car and the manager gave me the same story about not being able to refund the money into my account, because the car’s ownership has already been transferred into my name and the only way I could get the money back is if they sell the car on my behalf.

My mom spoke to dealership trying to resolve the matter and he gave her the same story saying he even has the papers in his office to prove ownership. I physically went to the dealership to pick up the documents, only to find that the documents are not there they are at the traffic department according to the manager, of which he told my mom that he had the papers.

My mom took it upon herself to go to the traffic department to find out about the documents on the 25th August 2016, only to find that there were no papers submitted, whereas the manager (Azeem) had changed his story two times saying the documents were already submitted last week Friday the 19th when I spoke to him, but in our face to face confrontation he said the papers were submitted Monday the 22nd and would take 2-3 working days to come back.

Fact of the matter is that I signed no documents, the difference of R16000 had not been paid and when I checked with the traffic department, no car was registered in my name like the manager (Azeem) had claime
