Poor service

Poor oversight to ensure that a Will comply with the formalities required in execution of a Will as provided for in the Wills Act 7 of 1953 and lack of accountability for such oversight failure The result your beneficiaries will be left with the burden of having the matter resolved (if it's financially possible).

Make sure that when you decide to accept the service of Capital Legacy to draft your Will, that they send you timeous confirmation (at least within 1-3 days) that your Will has been scrutinized and that it complies with all the formalities in terms of the Wills Act (ie. signature of testator, witnesses etc.). Should it not be correct, it would give you time to possibly correct it. Because on their website they promise to ensure that a Will is drafted in accordance with the relevant law, but I can assure you that is not always the case from personal experience. Ensure that you fully understand the process which Capital Legacy follows after notification of the testator/testatrix death, and the timeframes involved. Remember, these companies are primarily in it for the money (executors fees, policy premiums etc), they have no personal connection to you, so they have very little regard for your wellbeing or that of your beneficiaries after your passing. Also note that you are NOT obliged to take their policies on offer, which promises to cover certain cost after your death, they will tell you that if you cancel the policy, you will lose certain benefits, when really what they should be focused on is ensuring that you have a properly/validly executed Will. During free Will week, they do the most to advertise their services, promising you a free Will. They are not really “free” and they are not always executed in accordance with the formalities contained in law. This leaves a problem for your beneficiaries whom after your passing whom will need to fork out money to appoint a legal representative, who will have to approach the High Court to have your Will accepted. Without money to approach the High Court, your estate will dissolve intestate, which is most likely not what you wanted, hence the decision to go with Capital Legacy to have your Will executed.
