Estate Matter - Worst Service Delivery Experienced

I am writing this out of desperation and frustration emanating from the service received from Capital Legacy. I need you to note the timeframes as well as the numerous attempts I made before I could finally get my late husband's Estate handled.

On the 23rd of June, I contacted Capital Legacy, notifying them of my husband's passing, after which a meeting was arranged for the 30th of June 2021. The meeting was rescheduled to the 1st of July , after the meeting, there was an issue with winding up this Estate due to a lack of LPP and liquidity from the insurance policies. With the little knowledge that I have, Capital Legacy as the appointed Executor's has an obligation to carry out their duties, however, none of this was done. To date, the Estate has not been handled.

I had to continuously contact Mr Rijal Brown, till we finally managed to set-up an appointment to meet on the 31st of August 2021, to sign the relevant papers. Letter of Executorship takes approximately 3 to six weeks. If this Estate had been handled properly, my children and I wouldn't be in the dire financial crisis I find myself in at the moment. I need you to note the financial implications this has brought on to myself, as a parent trying to secure financing for her children.

I had to take money that was entrusted upon me by my late sister for her little boy. This amounted to R120 000 in his investment, including interest that he had accrued since April 2020. I would be utilising the money towards the payment of the monthly bond, while the Estate was being handled, hoping that it would last us at least between 4 to six months, at which I would have placed the home on the market once the letter of Executorship was received. Had the Estate been handled properly, I am under the assumption that I would have received the Letter of Executorship during the second week of August 2021 (based on the 6 weeks condition), which would have assisted me in putting the property on the market earlier. I cannot ascertain that the property would have been sold in those months, but at least something would have been done. My husband passed away in June 2021, three (3) months down the line nothing has been done. These months are critical towards the payment of the property as well as other expenses that are to be paid from my nephew's money. The current delay is also concerning, as it has been a full week since my meeting with Mr Brown on the 31st of August, and no correspondence has been received from the people who are supposed to have taken over the Estate. An Estate can take approximately six (6) to thirteen (13) months to conclude, depending on whether there are complexities or not. My husband's Estate was not complex at all, as I am the sole beneficiary (heir). Three (3) out of the thirteen (13) has been wasted already. I am kindly requesting for an acceleration on this matter, since the delay was caused by Capital Legacy. It should also be noted that I am a client of Capital Legacy as well, and this has become rather a concern, as I am worried that my family will go through the same should anything happen to me.

This communication will also be sent to Mr Ryan Thomas as my last resort
