****FIN

So after presenting Capfin with all the evidence and rules straight from the Credit Ombudsman mouth, that it is Capfin's responsibility to contact Experian and request that the listings on my Experian account must be removed from my report they still refuse to do so. Rizkah even rep**** in an email saying they can't do it. The Credit Ombudsman says you can Rizkah. You are not above the Ombudsman Capfin. The Account is from November 2017 and is 4 years and 7 months old meaning it has prescribed. Even if you sold it to DMC in 2020 it still falls under the original start date of November 2017. So according to Credit Law you the credit provider must send the instruction to Experian to remove the account from my history. Please update yourself on credit act laws. How many customers are you *****ing over after their debt has prescribed telling them the lie that you can not remove it. Confirm this with the Ombudsman and please do your job and send the email and get it off my Experian. And also inform your co dependent DMC to do the same.

You do not need to investigate anything. You need to follow Credit Act Laws and instruct Experian to remove Capfin and DMC from my history. But I assume this is like your other emails - just a robotic reply and no one will actually do anything. Bad Capfin, Bad DMC. Just replying so it looks like you care. Not falling for it.

I have just contacted your CEO Mr Eugene De Villiers on LinkedIn regarding Capfin's ******* behavior.

I will duly also forward this Hellopeter reply to him and your offices exposing Capfin's lies and refusal to confirm facts with the Credit Ombudsman. And also that after DMC said they are closing the prescribed account (the proof of which I sent to you) you as the original lender still refuse to instruct Experian to remove it from my history which is your responsibility. So you are blatantly breaking an NCR rule. Your company name is on my record. So YOU need to remove it.

Dear fellow South Africans please contact Capfin if you have prescribed debt with them on your Experian or Transunion credit reports. If you do it is your full right as per the Credit Ombudsman and NCR that Capfin instruct both credit bureaus to remove it in full from your history. But Capfin refuse to obey the Credit Ombudsman and NCR rules and have decided to keep your prescribed debt on the bureaus, which is against the law. Their number: zero six six three three four seven six seven nine OR zero eight two five two eight five one nine seven.

Here is Experian's Reply.
Once again stating it perfectly clear that it is Capfin's duty as creditor to instruct Experian to remove the history. But Capfin as we now know plays the fool...*******ly so.

Good Day Capfin
The Credit Ombudsman has just contacted me and they are personally referring this case to the NCR, as it has been 25 business days and you have not comp**** with the 20 day rule. I sent you the request on the 20 th of May 2022. And after 25 Business days you still send me smss and emails saying you have referrred it to your legal department. The Ombudsman also confirmed that I have given them more than enough evidence and proof that you are in the wrong and not acting according to credit laws. And it is, as I have been trying to tell you from the start - my full right that you instruct all the bureaus where you placed my prescribed debt to remove it in full.
The NCR will now explain it to you, seeing that your incompetence has obtained irrefutable status. All of the best.
