Non-Payment & Material Breach of Obligations – Serious Concern

I wish to formally raise a complaint regarding Cape Town Realtors (Pty) Ltd and the directors Gary and Daniel Welsh in respect of outstanding payments due and unpaid. I have been advised that the company is allegedly experiencing financial distress linked to *****, frozen bank accounts, and cash flow constraints. However, these internal issues do not absolve the company of its contractual and financial obligations to its clients and creditors. To date, payment remains outstanding, and the communication received contains no definitive payment plan, enforceable timelines, or guarantees. Instead, repayment appears contingent on uncertain future events, including property sales, loan approvals, and recovery of funds from third parties. This creates significant uncer*****y and places undue financial risk on those owed funds. From a governance and accountability perspective, this raises serious concerns. A business has a duty to manage its financial operations responsibly and to ensure that third parties are not prejudiced by internal failures, whether operational, financial, or due to alleged external *****. The current position effectively constitutes a failure to meet financial commitments, with no clear resolution framework in place. This is unacceptable and has resulted in financial and reputational impact. I would strongly caution any individuals or entities considering engaging with this company to undertake thorough due diligence and ensure that appropriate contractual safeguards and payment protections are in place. At this stage, I reserve all rights available to me in respect of recovery of the outstanding amounts.
