They dont want to pay but instead collect

Alright i had an accident on the 23rd of September 2018 whereby i hit a donkey which came from nowhere and crossed the road. The car was written off but instead of budget insurance helping me to replace the car, they rejected my claim by saying i was driving under the influence. I mean the accident happened next to the clinic and the police station, the police took a statement. The adjuster asked me if i consumed alcohol that weekend and i confessed i did consume the alcohol which was the previous day 22 September 2018 and the accident happened on the 23rd of September 2018 20h40. I mean they say i intentionally hit the donkey with my car. Is that fair??????
