Excess Recovery

In 2016 I was involved in an accident and the third party was at fault, I claimed through my insurance which was the quickest way to get my car fixed (***).

After the vehicle was repaired Budget Insurance advised that they will claim the excess from the third party being Savage Jooste.

This morning I received the below after requesting several updates with no luck.

"I refer to the above matter and our recent telephonic discussion.

Since our last update to you the matter has gone to trial and it was held that the defendant was the sole cause of the collision. They defendant's legal team however still disputes that all of the damages to your vehicle was caused as a result of the incident in question seeing as their expert is of the opinion that the damages was due to a previous incident. In order to prove that the damages was due to the collision we will need to prove the damages by leading expert evidence at a further trial.

We have been in discussions your insurers and they are of the opinion that the matter is no longer a matter that is commercially viable to pursue, seeing that amount of damages which could be recovered will be exceeded by the further litigation costs.

In light of the above, we have received instructions your insurers to abandon the recovery and to close our file.
