Claim Rejected

I had a single motor Vehicle incident on the 9th November 2024 during the evening. The vehicle was declared write-off by Budget insurance as the cost of repairs is not economical. I was then informed that I'm liable to cover the full cost of the vehicle as I did not exercise care and precautions to minimise the damage or loss. I understand that I was over the speed limit and I told the Assessor when he asked but, I've been with Budget insurance since November 2021 , never had a claim since or missed a payment. This is my second vehicle I have chosen to insure with Budget insurance I fully understand I was in the wrong but the fact that I am fully liable to cover the entire cost is ridiculous, I have been nothing but a loyal client to Budget , I've paid them over 25-30k if not more in the period I've been with them ,I was even due a cash back on the 10th December. I did not expect Budget to cover or settle my vehicle as it Is still under finance but just assist me so that i can at least try and fix my vehicle my self . the fact that they got their money every month on time for both policies I had with them and not feel any empathy for a loyal client that is now without a vehicle and is still paying for it is madness.

Theo Paxton [the Assessor] went to the accident scene ,took photos and reconstructed the incident and came up with the most absurd conclusion. After getting the information from the ECU and doing the calculations using various methods and equations taking into consideration the incident scene as well , he came to the speed calculation of 146 Km/h ,the road speed being 80, me telling him from the get go I was driving just under 120 as it was the N1 freeway.

He then created his report ,I only got a copy of it after they made their decisions and when looking through the report I noticed that the pictures taken and use from the scene was completely wrong . I went back to the scene ,I noticed that there was an accident at that location before mine, there was parts from a different colour vehicle laying to prove it because the damage to the barrier and the damage to my vehicle is not adding up and the spot where he is stating that my vehicle landed after knocking the barrier is a complete lie.

I am completely disappointed in Budget insurance, I Do not recommend them to anyone, they are good at saying life happens, we understand but when something happens to your vehicle ,they'll look for anything to not assist you and leave you to deal with it your self.

My vehicle has no popped airbags or cracked windows, only suspension damage and various knocks ,how the hell I could damage the barrier like that at 146km/h and get out the vehicle without scratch only God knows.
