Budget insurance was dishonest to me.
I took a policy for by dilivery bike that I'm renting out to the drive and the sales consultant did not advise me that the renting of the bike is not covered, when my bike was ******, I was then told the renting of the bike is not covered, below is what transpired on the point of sale. Ayanda Khubheka was assisting me with claiming, which the claim took more then 3 weeks and calling almost everyday and being told the claim is on final stage and now they are rejecting my claim.
I did advise that I am using the bike for deliveries and I was told that was covered, at no point of sale where I was told that the rental of the bike was not covered. When I made the call the sale consultant told me he knows the cover because its mostly ensured, So why he held the crucial information that rental is not covered. On all the questions as well as terms and conditions as per your sales consultant, no question was asked if the bike is used for rental or not, if Budget insurance don't cover such, why was that information not told to me. As per FAIS Ombuds report highlights that failure to disclose material information by the insurer, such as policy exclusions or coverage limitations, can and will lead to significant consequences, including settlement of the claim, it is crucial for an FSP to ensure that all relevant information is communicated to clients at the point of sale to avoid potential breaches of the FAIS Act and other consumer protection laws. That was not done to me. Why? The policy document that I received do not have information or exclusion that bike rental is not covered. My understanding since the policy is full comprehensive insurance, and motor cycle use is POOL driver, and the rental exclusion was not told at the point of sale and it is not on the exclusions on the policy document, the policy must cover the bike fully. I was only told about this information at the point of claiming, I feel that the FSP was dishonest to me at the point of sale. As per FAIS if and when the FSP is dishonest on the point of sale ,the FAIS Tribanal can take action towards the FSP that can include debarment.
I need my claim to be relooked at as I feel I was not treated fairly by the FSP which is Budget insurance, I feel they were dishonest to me by holding crucial information to me that was the key for me to make a crucial decision of whether I take the policy or not, I would understand if I was asked if I use the bike for rental and said no, that will be dishonest to me however that question did not come to me and with my understanding, I did answer all the questions that was asked with honesty. The policy has a cooling off period, where I can cancel the policy if it does not meet my needs or if I do not understand the policy I can call the insure after receiving the policy if there is something that I do not understand, so since the rental was not on exclusions, to me the policy was what I needed. As a client I can not suffer the grey area that was caused by the FSP which is Budget Insurance. I need my claim authorized if not I will be taking this matter further going to Hello Peter and Ombudsman
