Bt Games do not follow CPA regulations and no concern to customer service

I purchased Assasin's Creed Syndicate game from the Bt Game store at Forest Hill Mall on Tuesday afternoon at 17:40. This was part of a birthday gift pack to my 16 yo daughter. The game was opened in my presence on Thursday morning and we proceded installing the game to her PC. After registering the game with Ubisoft as was required, we commenced with installing the actual game, Disc 1 loaded with no hassle and the software requested for the 2nd disc to be inserted, The second disk start download and then stopped. We restarted the process several times (2nd disk alone as well as from disc 1) with no success.

I replaced the discs in the disc holder/cover and return it to the store in Forest Hill Mall on the same day. On my arrival at the store I was informed by the store manager, Josiah (after explaining to him what the disc 2 is doing and inspection of the discs by himself), that he cannot replace the game without testing it first. I agreed, but then he said he cannot test it in the store and needs to take it home to test, which brought up red flags. I asked him that surely that could not be correct as this is not good business practice. He insisted that he needed to test it at home. We agreed that he will call me on Friday with feedback.

I left the game in his possession and left the store, but did phone the 086 number of Bt Games to confirm if the testing at home is standard procedure, which was confirmed by the Bt Game staff member on the other side of the call. Friday came and went with no call from Josiah.

On my return to the store on Saturday morning I was informed by Josiah that he managed to load the game on his PC and laptop with no hassle. He further suggested that the problem is with my "ROM" which I declined as my kids play dvd's and other games with it without any hassle whatsoever. He then proceed to point out that there are scratches on disc 2 to which I rep**** that there were no scratches on the disc when it was handed over to him on Thursday and he had inspected the discs on at the time and should have pointed it out then if he was of the opinion the scratches are due to our handling.

Josiah then phoned his Manager (I assume) where after he then informed me that they will replace the game, but this will only happen on Monday. At this point I requested a refund and suggested that I go and purchase the game somewhere else as this was a present that is now already 3 days late. He refused and said I have no option, but to wait till Monday.

I feel that the whole process of testing the games at the staff's private homes and computers cannot be normal practice and leaves huge loop holes for piracy issues. Furthermore the fact that they refuse a refund after they cannot replace the game immediately must be against the CPA regulations where it is totally against the consumers wishes.

I will go back on Monday as I do not have a choice as per Josiah, Bt Games Store Manager and see what the outcome is.

I'm posting this to warn other prospective gamers and/or parents to be very careful and aware when you enter a Bt Game store to purchase a game. I feel they need to be able to test the game at the store to cut out any disputes or possible issues and to prevent causing such deep dissapointment as my daughter has now over her disaster of a present that was meant to bring joy on her birthday.
