<p>My SLK ********** model went in for repairs due to an accident, while under their care somehow they managed to damage the Transmission Control Unit in the Automatic gearbox a very expensive piece of the vehicle rendering it un driveable. And is now refusing to take responsibility for their actions. It has already been proven the damages did not originate from the initial accident by Discovery. I happen to have a Vitality Drive DQ Tracker installed in my car and its showing odd times my vehicle was on the move and there is a 29km discrepancy on my cars odometer..clearly they have been driving it around. This unit is not a "ware and tare" component and either it works or it does not as it is an electrical"computer control unit" component on the valve body and conductor plate of the Transmission.</p> <p>I also have proof that the vehicle had none of these problems when the first diagnostics report was done by Mercedes Bryanston. I also have proof of the second diagnostic report that was done by Mercedes Menlyn after I found my car in this state and demanded an answer, the time difference between these documents is about a month apart....clearly showing the damages had to have happened while in their care. They are refusing to adhere to the Consumer Protection Act of 2008 section 65(2) which clearly states the following:</p> <p>(2) When a supplier has possession of any prepayment, deposit, membership fee, or</p> <p>other money, or any other property belonging to or ordinarily under the control of a</p> <p>consumer, the supplier—</p> <p>(a) must not treat that property as being the property of the supplier;</p> <p>(b) in the handling, safeguarding and utilisation of that property, must exercise the</p> <p>degree of care, diligence and s**** that can reasonably be expected of a person</p> <p>responsible for managing any property belonging to another person; and</p> <p>(c) is liable to the owner of the property for any loss resulting from a failure to</p> <p>comply with paragraph (a) or (b).</p> <p> </p> <p>I rest my complaint there. </p> <p> </p>
