Early notice period

I have been renting from BRM Property Service for just over a year now. BRM was aware that the house we staying in was going to be sold. The agent Bernice let us as tenants sign a new lease agreement in Novembre 2023, and December 2023 a month later she advises us that the house is on sale and will be sold, we will be notified accordingly and we should allow access to the property for possible buyers to view.
I as the tenant then took it upon myself and mine and my kids well being to seek for a new place to rent of which I now found and is vacant immediately I notified BRM about this and she said I have to givie 2 to 3 months notice as I have a signed lease, yes I have but why was the lease then not made month to month knowing the property is being sold and a month after signing the lease you advise us the property is being sold.
So I am moving and she refuses to give balance of my 2 month deposits back which amounts to R16,000.00 of which I told her she can use R3800.00 for the gate to be repaired and a portion for cleaning service as she uses her own cleaning services to clean. Her responds to this is i am liable for 2 months rent because I did not give the notice period according the lease agreement fair enough i did not but I was advise a month after signing the lease the house is being sold. So she is only looking out for the landlord and not us as tenants because she has sole mandate to sell the property.
I feel I am within my rights as a tenant to look out for myself and my kids if the house is sold where must me and my kids go. so I have a place and will be moving Friday 26/01/2024, and I will require the balance of my eposit as I need to pay deposit at the new place.
Please hellopeter.com assist I have e-mails tracking this since November 2023 after we signed and December we were informed of the sale of the property.

This is a mail I received from BRM Property Service.
Dear Nicola Your deposit held in trust was R14783.92 (Original deposit R14000 + interest) Deductions as follows: February 2024 rental : R8560 Cleaning Costs : R1600.00 (cleaning costs higher than R1000, owing to badly scuffed walls and stains against internal walls) – please bear in mind this premises was freshly painted upon your move in, The landlord is only holding you accountable to wash down the walls. They could has asked for an internal repaint. Fumigation : R800.00 Gate Repairs : R3800.00 Total Deductions currently, is R14760.00 As I pointed out to you in one of my previous emails, your deposit is very lean and there is even a chance that it will not be enough to cover your liabilities. Fortunately the contractor of the gate agreed to keeping the price the same and you are not being asked to paint out the badly scuffed walls – the passage and area where the ink stain is are the worst of the walls. The damage caused to the gate is even more extensive – the downpipe under the carport is also broken and will need to be resecured and the gate motor is not working, as well as a section of gate track that is completely missing. These things could not be tested on your move out walk through as the gate was non-functional. The landlord was never informed that the gate motor is also not working when you reported the damage to the gate. A working gate and motor was provided to you at the beginning of your lease agreement. There are insufficient funds to cover these repairs as well. Once I have paid out all the contractors for services rendered I will send you a full statement of your balance due. There is no reimbur*****t to you of the deposit. The deposit is in fact, insufficient to cover all your obligations on this property. Regards Bernice
I have reached out to this woman several times to at least pay me part of my deposit, I am going through allot she had no problem accepting my depsoit now all these excuses not to pay my deposit. I need help urgently. My mail below which I sent her yesterday and she clearly ignores all my e-mails.
Dear Bernice Firstly the house was clean, and it is the landlords duty to paint their houses. I have been renting for years and my previous landlord ensured that her house was painted annually notmal wear and tare within a year. Cleaning are you crazy the house is clean you want to take R1600.00 just for cleaning daylight ******* I am going to take this further with you. Firstly you let us sign a lease agreement in November for a year why did you not do it month to month answer this question because you seem to be avoiding this question in all my previous mails. On the 2/12/2023 you advertised the property on Property 24, you only notified us the 12/12/2024 the house is on sale so who is at fault here. I want my deposit asap, I will be taking further steps you messing with my money I must pay a deposit where I am now. Fumigation R800.00 where do you get all this. You know you knew we had water meters and almost every month you send us a bill for water says allot about you thinking we wont pick up. I am telling you now you pay my balance of my deposit immediately you have such allot of bad reviews on hellopeter.com and wow would this be news for them let see what the public thinks and how it will help your business. Do not mess with peoples hard working money, we paid our rent on time and with no problem, so do what is right. I want R8,000 in my account before end of week.
Dear Bernice It is with a heavy heart that I am mailing you. I prayed and asked God to work with you and do what is right you do not understand my situation. For one I am going through a messy divorce which has crippled me financially, an abusive husband that threatens me and knew also where I was staying one of the other reasons I had to move away there, and the fact you guys were selling. You know it saddens me to think people think they know your circumstances when in actually fact they don’t. I do not wish to argue I am asking you in a Godly manner to do what is right. Give me R5,000.00 of my deposit and keep the rest I am being more then fare here there is no damages its normal wear and tare, the only major damage there is, is the gate which is R3800.00. And you did say you guys use your own cleaning services. So again, for one last time I am asking you to do what is right as a Christian and a Business woman.
