<p>Last year not sure which month while I was doing shopping at The Workshop in Durban Central a Promoter from Body Lab approached me and advised that Body Lab is having a month free trial and if you not interested afterwards you can just inform them so I tried the gym but it was not for me because it's always packed no equipments to utilise and you wait an hour or 2 to shower so when I went to cancel was told I need to pay 30% cancellation fee which I was not advised off at first because I was told it's a month free trial and it was only 2 days and the unprofessional manager advised that I was supposed to cancel in 5 days not knowing I was signed for a 3 year contract and now I'm called by lawyers</p>
The above mentioned complaint refers.
The complainant signed a 24 month contract with the service provider and not a 36 month contract as he avers.
The Complainant went further and registered a debit order with his own banking service provider using his own bank details as well as his own PIN number.
The service provider never received any form of cancellation as per the Consumer Protection Act.
The Complainant alleges that he was never informed that he could cancel and how he could cancel is simply not correct.
The Complainant specifically signed off on the paragraph explaining the 5 days cooling off period and also specifically signed on the paragraph explaining the cancellation clause as per the Consumer Protection Act.
