SMG BMW Richards Bay: Undisclosed VDC Repairs on R1.78M "Demo" & Withheld Trade-In Funds

On 29 May 2026, I purchased a vehicle from SMG BMW Richards Bay that was explicitly marketed, classified, and ordered via the official manufacturer portal as a premium BMW South Africa corporate "Demo Vehicle". Upon taking delivery, I discovered a cosmetic defect regarding the factory badging. When I formally raised this discrepancy, I received a written admission from a BMW SA representative confirming that this specific unit had actually undergone a "VDC (Vehicle Distribution Centre) refurbishment" prior to retail. Selling a vehicle as a pristine, standard corporate demo while hiding a material repair and refurbishment history is a severe and direct violation of Section 41 (False, misleading, or deceptive representations) of the Consumer Protection Act (CPA). A premium flagship vehicle should never be delivered with a hidden repair history. Under Section 56 of the CPA, I immediately exercised my statutory right to demand a transaction reversal or a direct vehicle substitution on equitable terms. Instead of resolving their error, the dealership has attempted to stall and treat this legal dispute as a standard "used vehicle" to evade financial accountability. To make matters worse, SMG BMW Richards Bay is currently engaging in prohibited conduct under Section 40 of the CPA by completely withholding the surplus cash-back funds legally owing to me from my traded-in vehicle. They are actively utilizing my personal capital as unauthorized financial leverage to force my compliance in a completely separate product quality dispute. Despite a formal final demand notice, the dealership has allowed my deadline of 12:00 PM today, Monday, 15 June 2026, to expire without releasing my funds or providing a compliant resolution. Be advised that formal legal disputes have now been concurrently lodged with the Motor Industry Ombudsman of South Africa (MIOSA) for the vehicle misrepresentation, and the National Consumer Commission (NCC) for the ******** retention of my trade-in funds. I advise all prospective consumers to exercise extreme caution when dealing with SMG BMW Richards Bay.
