BMW Unfair Warranty Suspension

On the 23rd Dec 2019 my BMW 3.20i MSport showed a warning sign 'Engen Overheating'. I immediately stopped, called BMW road assist for towing and they took my car to BMW in Port Elizabeth, Greenacres.

On the 24th Dec 2019 I was called by Sulante Prinsloo around 9am to tell me that my car service was overdue by -11000km and therefore the warranty has been suspended. To diagnose the car they requested R2500.

I drove there immediately as this did not make sense since I had called to book for service in October when car displayed 'Service due in 6000km' and the same Sulante Prinsloo told me that I should drive until the car displays 'Service due in 2000km' which it had not yet done. It is strange that the overheating is now blamed on me not servicing the car. It also does not make sense that I have exceeded service by 11000km when I do not drive this car very often. There is clearly an error but BMW would rather blame me than take responsibility.

I had a long argument with Sulante Prinsloo and service manager John Kroukamp after which they promised to send an email to BMW finance and plead on my behalf. On 31st Dec 2019 I called them and they said they haven't received response yet.

On the 3rd Jan 2020 they called to say the request has been declined and will now send email request to top Manager from BMW SA dealer.

They have never contacted us since then so I went to the salesman who sold me the car on the 16th Jan 2020 they called same day to say the request has been declined again by BMW SA, Gavin Crocker, and there is nothing they can do on their side so its up to me to fight it.

Today I went there to request the emails and phone recordings to lay a formal complaint but they refused and even denied the emails existance even though they said to me multiple times they were waiting for email responses.

This is my third BMW and is very frustrating to be treated like this. Can BMW treat its customers honestly and sort this out.
