Unapproved optional extras

The Consumer Goods and Services Ombud has ruled in my favour. Do yourselves a favor and insist on getting preadvised and signoff all optional extras.

"Good day,

We refer you to the above reference complaint at our office. Kindly be advised that the services and product that your office provided to the complainant does not adhere to the requirements as per section 54 and 55 of the CPA. The pool cracked within 6 months and as such, the complainant is entitled to a remedy as per section 56 of the CPA.

Further take note that section 15 (4) of the Consumer Protection Act states that "If a supplier has provided an estimate for any service, or goods and services, the supplier may not charge the consumer a price for that service, or those goods and services, that exceeds the estimate, unless after providing the estimate— (a) the service provider has informed the consumer of the additional estimated charges; and (b) the consumer has authorised the work to continue."

Your office failed to consult with the complainant with regarding the said "optional extras". Section 15(2) further states that the supplier or service provider has given the consumer an estimate that satisfies the prescribed requirements, and the consumer has subsequently authorised the work". You failed to provide the complainant with an "estimate" of the work that will be done with relation from the jackhammer. It is further advised that the consumer did not authorise the work upon being given the estimate, which the consumer never received.

As such, our office recommendation is as follows, at you proceed to repair the poor as per section 56 of the Consumer Protection Act.
