Bad service from APEX Bellville/ Big Boy Bikes

I bough a Big Boy 250cc at APEX, 44 Strand road, Bellville, Western Cape. The bike was collected on Wed 4 April 2018 @ 16h20 at APEX was taken for a test drive and was brought back 10 min later because of an faulty speedometer. We were told to bring the bike back the following day so that it can be looked at. The petrol tank was also filled at the petrol station and we noticed a leak of petrol via the petrol cap when we arrived home.

We will have to return the bike as it has 2 factory defects that are a big safety concern for us and other motorist. The safety concerns are:

1. Speenometer not working and reported within 10 min of collecting the new bike. 2. Petrol Tank lid seems not to close snug and securely. Petrol is leaking out.

Both issues makes the bike not safe for for the road and we are not satisfied with this purchase. We can not accept a bike which is new with these defects - it stands to reason: what else is wrong. According to the Consumer protection Act we have "Right to quality goods and services"

1. Consumers have a right to return unsafe or defective goods within six months and may choose either: • a refund • a repair • a replacement It is the consumer’s right to chose either of the above and a supplier/ retailer may not decide for the consumer. If the goods break again after six months, the consumer may return the goods within three months for a refund or a replacement.

We would like a replacement bike or our money back, please. We were informed on 6 April 2018 by APEX: "We have already ordered a replacement speedo drive under warranty claims as we completely agree this should work especially being a new purchase" It is now nearly 2 month later, The bike is on the rad *******ly as the speed can not be determined - as the speedometer is faulty. It is now 31 May 2018 and we are still waiting for the repair/replacement bike/money back.
