Poor Service Delivery and Failure to Comply with the NCPA

On the 9th of June 2018 we went to collect the motorcycle advertised for R88900.00, a 2010 BMW S1000RR on Gumtree. The add clearly stipulated that the vehicle was well maintained and had a full service history with Bmw. Johan did not run through the motorcycle with us, but merely just handed it over and gave him a collection notice to sign and that was that. Later that evening the exhaust started to leak significantly and we noticed that the hooter and turn signals on the left handle bar were faulty and did not work.

On Monday the 11/06/2018 we took the bike back and was told the hooter and turn signals were working before we picked the motorcycle up. How can these components fail at the same time only after the bike is collected. Suddenly it became clear to us why Johan did not run through the bike - as this would have been picked up prior to collection, Johan told us that there's no warranty for the bike but he'll have the exhaust and hooter replaced and the switch looked at. We left the bike with Bikes 4 Africa that day.

On Tuesday 12 June 2018, Johan called us to say that its not the hooter that's not working but its the switch which is a common problem on these bikes and even if you change it, it would happen again so he did not sort the faulty turn signal or the hooter saying that the bike must have been parked in the sun, I mean really? He refused to accept all responsibility from the sale, placing the responsibility entirely on the purchaser.

We collected the bike on Wednesday 13 June 2018, and only the exhaust leak was sorted out not the hooter nor the turn signals. The bike was then parked off till the weekend only to discover that they failed to replace an exhaust clamp and now the exhaust is leaking. All this happened within seven (7) days of collecting this vehicle. Aren't all dealerships held accountable by the Consumer Protection Act.

On Saturday 30 June 2018 we once again took the bike back to Bikes 4 Africa because the bike wasn't starting every time, and there was now no sixth gear. A friend rode the bike there as I was working ......... Johan said it's because my friend rode the bike too hard that this occurred. These motorcycles were built for racing! Is a person supposed to ride a 1000CC at 50km/h? Johan said he wouldn't accept the bike back in this condition ....... what condition did he allow it to be sold in? Johan then told us that the note signed on collection says there's no warranty for motorcycles older than 5 years, so he is not responsible for any repairs.

Too many things have gone wrong since the collection of the bike ............ did it even undergo a COR? Or was it repaired just long enough to last until they could claim that these faults are now repairs. We find it extremely strange that the bike was standing stationary in the showroom, and in such a short space of time after being ridden all these things start going wrong.

The reason we opted for this buy and not a private one is that a dealership is supposed to be reputable. There could be many problems with a private buy too, but the fact that this bike supposedly came with a COR from a reputable dealership is why we opted for this buy.

Much time off work to and from Bikes 4 Africa, and on the telephone .......... not to mention the stress has resulted in being fruitless - Since the collection of the bike there has not been a day without a problem, and nothing has been resolved.

We did everything to assist this buyer. She bought the bike for her boyfriend who then gave it his friends to ride unsupervised. Every time they brought the bike in we repaired broken parts. The bike has a quick shifter on and when the 6th gear failed we took the bike to a top BMW mechanic and his verdict was that when using the quick shifter you can get a false neutral between 5th & 6th, the correct procedure is then to shift up using the clutch and in this case it was forced up. When you have friends who don't know how to ride correctly riding your bike then you cant expect to keep holding the dealer responsible for the breakages

WE DID NOT APOLOGISE AND THIS STATEMENT IS INACCURATE. The quick shifter was not the cause of the sixth gear failure. The mechanic who investigated the cause stated that failure was due to selector drum bolts coming loose and the washers dropped in and damaged the sixth gear ........ WE HAVE PAID FOR ALL REPAIRS. We have since discovered that we are not the first people to have had problems with Bikes 4 Africa, and their name does not bode well in the industry

I would like to state the the Motor Industries Ombudsman has given his final verdict on the above mentioned case and has ruled in our favor against Mrs De Vos.
