Contradiction in the contract
Tyreguard has paid out according to a second hand car with new replacement tyres.

I.E. with less than 40 000 km's they have paid 50% of tyre value rather than 60% value.

The tyreguard insurance was offered on the car as it stood with the original tyres. The insurance is only offered on new tyres and it is well known that the tyres are the original tyres on the car - thus Bidvest accepted the tyres to be original and new, it is then a contradiction to claim the car to be second hand.
If the car was considered second hand and the tyres original then they should not have been considered for tyreguard - or not qualified for tyreguard.

You cannot consider a vehicle to be used while deeming the original tyres on said vehicle to be new. Least it be a contradiction in terms in order to be deliberately misleading.
