The complaint by Nicci is indeed misleading and appears to be deliberately posted and misplaced. There is a process to be followed before terminating any managing agent’s contract. We have gone through a similar process in my complex before we appointed Berader and I must say we very happy with the move to them. We finally getting service that is to standard from a no-nonsense, honest and reliable managing agent. They go the extra mile and question all decisions, implement procedures for the common good of all owners in the scheme, so we certainly will recommend them as a service provider.
The correct process after the Trustees passed a resolution to terminate an existing contract would be to call an Special General Meeting for the majority of owners to agree on the passing of such a resolution at an SGM (this is not only a Trustees decision as sometimes Trustees fall into the trap of “benefitting” from change and thus owners need to monitor all changes to ensure that all parties remain accountable) , after this you would still have to give two calendar months-termination-notice form the date of the SGM if owner agreed to such a change. So indeed the agent would be entitled to the full payment of 3-months i.e. current plus two months (i.e. end of notice period). So if Nicci was advised by her new agent (appears clearly not done), followed a process of due diligence she would not have been frustrated in the process.
