AN OPEN LETTER TO BIKEFIN FINANCE CEO. REGARDING BIKEFIN FINANCE COMMITTING ********** MISREPRESENTATION OF CONTRACT.

In December 2014 I went to Lifestyle Yamaha in Roodepoort to purchase a Yamaha FZ6F Fazer brand new. Lifestyle Yamaha could not locate a Yamaha FZ6F Fazer at that time so I canceled the order. Lifestyle Yamaha said the bike would cost R85 000.00 with a R3 500.00 deposit. About a week later Lifestyle Yamaha phoned me to tell me they now indeed have a Yamaha FZ6 Fazer. So I went to Lifestyle Yamaha to buy a Yamaha FZ6 Fazer. After arriving at Lifestyle Yamaha roodepoort the dealer showed me the bike, but it did not look like a FZ6 Fazer so I asked him wby this bike looks different from the one in the brochure. He explained that this is the brand new 2014 version and it is indeed a FZ6Fazer. Then told me that since I canceled our first agreement that Bikefin have now upped the deposit to R7 500.00 I complained about it and he quickly got a representative frome the bank to speak to me. The lady on the phone said hello mr Cooper I see you are buying a Yamaha XJ6F, to witch I rep**** no sorry you're wrong, I'm buying a Yamaha FZ6 Fazer. She said no mr Cooper you are buying a Yamaha XJ6F, to witch again I said no mam I'm buying a Yamaha FZ6 Fazer. The lady then said please let me speak to the dealer and I handed the phone to the dealer, while I was looking at helmets. About five minutes later the dealer gave me back the phone and the bank consultant said hi mr Cooper sorry for the confusion, I see you are indeed buying a Yamaha FZ6 Fazer. Sge then took details from me and between herself and the dealer completed the Bikefin application. I signed the contract as it clearly showed what I was buying and what I wanted. After a year I needed to re licence my bike and requested a copy if the registration papers to get a new licence disk for the bike. When I got a copy of the registration papers I noticed it stated Yamaha XJ6F. And not the bike I thought I bought. After phoning the bank I was told it's too late to do anything cause the contract is over a year old. I was angry and did not know what to do about it other than complain. Still the bank done nothing to fix the problen or compensate me. It was only after I stopped paying that bikefin decided to change the contract in court without my notification, consent or knowledge. Bikefin legal team have been trying now for 4 years to repossess a bike that does not exist. Bikefin along with Lifestyle Yamaha colluded to commit ********** MISREPRESENTATION OF CONTRACT against me. And I find it shocking that bikefin knew from day one that I was de*****ed and still to this day know I have been de*****ed ans yet they will do absolutely nothing about it. So far it has ruined seven years of my life and still no end in sight. I niw call upon the CEO of Bikefin to take charge as their legal team have now tried for four years to cover this case up. Please Bikefin CEO stop this madness.
