No Refund of R300 to a Pensioner
We booked accommodation, and had to cancel due to inaccessible R364 and R365., road conditions as we drove through storm. We signed no conditions and received no written email confirmation of our booking. Supplier refuses to refund any part of our deposit!! We cancelled withing more than 24 hours. Please see clause from tourism board, this behaviour is *********. "Reasonable" Cancellation FeeAccording to the Consumer Protection Act, the fee must be reasonable. The supplier cannot keep 100% of your deposit just to punish you. Reasonable Cancellation Fee: Under the Consumer Protection Act, suppliers can charge a cancellation penalty if your cancellation causes them financial loss (e.g., they couldn't fill the room).The "Replacement" Rule: If the landlord or accommodation provider manages to secure another tenant/guest for the same period, they must return your deposit (or a proportional amount) because they have not suffered a financial loss.Proving Damages: The supplier cannot arbitrarily keep the entire deposit; they must prove that their losses, such as marketing costs or lost rent, equate to the amount of the deposit they are withholding.
