RE: VW BARONS BRUMA // VW SA // VW MANAGING DIRECTORS OFFICES // VW LEGAL DEPARTMENT
We purchased a brand new VW Amarok PanAmericana from VW Barons Bruma (the dealership) on 10 JULY 2024. After driving approximately 3500km the vehicle went into limp mode with a fault code appearing on the dashboard.
The vehicle was then taken into the dealership and kept there for over a week, only for them to indicate there is no issue and we were advised to collect the vehicle.
As the vehicle approached 5000km the same issued occurred, and it was taken back to the dealership who kept the vehicle for one month three days.
My husband specifically advised the dealer that the vehicle should be driven consistently on the highway for 30 minutes for the fault to appear and for the vehicle to go into limp mode.
After over a month we were advised to collect the vehicle as we were once again advised that no repairs could be conducted as the fault could not be replicated.
The vehicle was in the dealerships possession for 30+ business days and we provided them with specific instruction on how to replicate the fault.
The vehicle was collected and driven for approximately 600 km with the fault code appearing again after driving on the highway.
We addressed correspondence, through our attorney, to the dealership and VW head office requesting the following: • Daily log reports of all work conducted on the vehicle; • Procedure utilised to clear the fault code; • Procedure to return the vehicle for a full refund in terms of the CPA;
All our requests were ignored and we were advised to return the vehicle once again for testing.
Furthermore, we were advised that the vehicle was driven extensively to replicate the fault however we have tracker reports which show the vehicle was only utilised twice.
VW head office failed to properly respond to our correspondence and only responded after more than 3 weeks after numerous follows merely advising us to bring the vehicle in for further testing and ignored all our requests.
Thereafter, we were advised that we should call roadside assistance if the vehicle breaks down again. This poses a serious security risk to my husband who had the intention of armoring the vehicle for security purposes and cannot risk being broken down on the side of the road especially in a brand new vehicle.
We have no confidence that this issue will be resolved as the dealership had ample time and opportunity but could not diagnose the issue.
Furthermore, VW head office and their legal department took weeks to respond, with nothing of substance.
Our latest correspondence remains unanswered since 11 February 2025.
We would like to facilitate the return of the vehicle for a full refund as the vehicle is not suitable for the purpose it was purchased and VW cannot diagnose and resolve the fault on their own version.
